Can I be fired from my job if my doctor signs me out of work due to back problem caused at work?
I pulled a back muscle at my workplace and was unfit to perform my duties. I went to my doctor for advice and she asked if I feel fit to work and I said no because I am in a great deal of pain. And she reccommended that I stay off work for 2 months while my back recovers from the muscle trauma caused. In the end the company sacked me for too much absence. People have said that because the doctor supplied me with a medical certificate they cant sack me but they did.......

(assuming you are in the USA.....)

If your company has more than fifty people employed in the USA and you have worked there at least a year (it might be less)...then if falls under FMLA.

FMLA gives you up to 3 months off and guarantees that you have a job when you go back..

You won't get paid under FMLA unless you have short term disability insurance though. Typically, state paid unemployment won't pay you for this type of thing.

Based on your slang I am guessing you are in the UK. I don't know the labor laws there, but in the US if you hurt your back on the job, you not only can't get fired, but the employer's insurance must cover all costs associated with the injury and lost work time. Now with that said, one of the most common cases of fraud involve workers who claim back injury. In the US, insurance companies are now beginning to investigate this fraud and prosecute those involved. Also, due to better scanning technologies it is getting harder to claim injury that isn't there since the new technologies make soft tissue visibility good. To me, two months seems like a really long time to be off unless your back is very seriously injured. That being the case, you should have good documented medical evidence that supports your claim. I would contact your labor board if you have one, and are not scamming. If you are scamming, look for another job. They will find out and you can go to jail for fraud.

Edit: The English labor laws seem to be a bit more in the favor of the employer since past reliability is taken into account. I think this is good. In the US we can drug and alcohol test people who get injuries to make sure they didn't cause it by being under the influence. I had this happen to one of my employees once who came up positive for marijuana.

If you are in the US, then no, they can't fire you. First of all, you need documentation from your doctor saying that your injuries were caused as a direct result from your job. Then you need a lawyer! If they've already fired you, I personally wouldn't want the job back, but I would want monetary compensation!

IF you are in the UK, they are not allowed to sack you while you are ill and certainly if you have suffered an injury at work.

In fact you have a very good case to take them to court and get compensation. Contact one of those injury lawyers, no fee no win.

The law states that a company can not sack you unless you have been off sick for close to 6 months. In addition you where insured at work - so they could have a health and safety issue as, well and that should get you compensation too.

Sacking you may have been the best thing this company could have done for you. You have a great case for compensation.

Go and get a lawyer now.

These back problems like herniated discs can take a minimum of six weeks to six months to remedy and if you have a good doctor they will recommend surgery after six months.

You might need an attorney to help with the sacking.

I think it's free if they take your case on. A friend of mine used them when he was made redundant and he won an extra pay out on top of his redundancy and got his job offered back to him. He told them to shove it btw.

It depends if you are in the UK or the US as the laws are different.

You can be dismissed if your absence record is not good enough.
Normally it is not just for the one absence it is for repeated absences/lates etc.....

Sounds like unfair dismissal to me. You will need to find a solicitor if you plan to take it to an industrial tribunal.

they can not sack you if you have a medical certificate, this is unfair dismissal, the most they can do is call you in for a meating to determine how long you will be on the sick for and if they need to find temporary replacement, you have two claims here if you take it to court, one for the dismissal and one for the work related injury. write to the company and tell them yo intend to take further action, they will soon sort it out.
